PLEASE READ THIS AGREEMENT CAREFULLY. By installing, copying or using Auto StandBy Pro (the "Software"), you agree to be bound by it. If you do not agree, do not install or use the Software.
The Software is provided by Phenomenal Solutions ("we", "us"). You can reach us at [email protected] and through www.autostandbypro.com.
The Software has two editions:
(a) Auto StandBy Pro (the "Free Edition"), which is free to use and needs no license key.
(b) Auto StandBy Pro Plus (the "Plus Edition"), which adds features such as HTTP triggers, Power Requests triggers, separate mouse and keyboard triggers, day/time profile scheduling, a background service that detects activity in every Windows session, and priority support. Plus is activated with a license key that you buy.
This agreement covers both editions. The Plus Edition is the same program as the Free Edition; Plus features are switched on by a valid license.
(a) Free Edition. We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Free Edition on any number of computers that you own or control, for personal or business use, at no charge.
(b) Plus Edition. After you pay the license fee, we grant you a personal, non-exclusive, non-transferable license to use the Plus features on up to five (5) computers that you own or control at the same time with one license key. A Plus license belongs to the computer it is activated on: every Windows user of that computer can use Plus. You can move your license to another computer by releasing the old one from the program ("Delete Registration") or from "My Licenses" on our website.
(c) The Software is licensed, not sold.
You may not: (i) copy the Software except to install and run it as allowed above and to make a backup; (ii) sell, rent, lease, sub-license or otherwise transfer the Software or your license key, or share your license key publicly; (iii) remove or alter copyright or proprietary notices; (iv) modify or create derivative works of the Software; (v) circumvent, disable or tamper with the license check, the license files or the background service, or use the Plus features without a valid license; (vi) reverse engineer, decompile or disassemble the Software, except to the extent the law of your country gives you that right despite this restriction.
The Free Edition may be passed on to others only unchanged and only as downloaded from www.autostandbypro.com. Redistribution on other sites or bundled with other software needs our written permission.
To activate and keep a Plus license valid, the Software contacts our server and sends your license key and an identifier derived from your computer's hardware. The Software may check the license online from time to time. A license key can be revoked if it is shared publicly, used on more computers than allowed, refunded, or the payment is reversed (for example by a chargeback). If a key is revoked, the Plus features switch off on your computers and the Software continues to work as the Free Edition. If you believe a key was revoked by mistake, contact us.
- We collect only what we need. When you buy Plus, our payment provider (PayPal, or the Bitcoin network) gives us your name, email address and payment details needed to issue and email your license key and to handle refunds. We keep this information as long as your license exists and as long as the law requires.
- When you activate or release a Plus license, the Software sends us your license key and the hardware identifier.
- When the Software checks for updates, it sends its version number and edition.
- If you use the feedback forms on our website, we receive what you type.
- We do not sell your data and we do not use it for advertising. We share it only with our payment provider and where the law requires.
- You can ask us to see, correct or delete your data at [email protected].
- The Software itself runs on your computer. Your rules, profiles and log file stay on your computer and are not sent to us. The log may contain technical details of your computer, such as its model, BIOS and Windows version, the sleep states it supports and the names of programs or drivers that keep it awake. It stays on your computer unless you choose to send it to us, for example when you ask for support; we then use it only to find and fix the problem.
To work properly the Software runs with administrator permission (Windows asks for it the first time it starts) and registers a scheduled task. With a Plus license it also uses a Windows service. The Software can change your computer's power settings and can put your computer to sleep, hibernate, restart, shut down, lock it, log users off or run commands that you choose, according to the rules you create. Uninstalling the Software removes the task and the service.
Actions such as shutdown, restart and log off, especially with "Force applications to close", can close programs and lose unsaved work. You are responsible for the rules you create and for testing them. We are not responsible for any loss caused by a rule you set up or by an action the Software executes as you told it to.
We may release updates, but we are not obliged to. We may change, replace or stop the Free Edition at any time. Support is provided by email at [email protected] on a reasonable-effort basis, with priority for Plus customers. We do not guarantee a response time.
You may ask for a full refund of a Plus license within 14 days of purchase, without giving a reason, by emailing [email protected]. When a payment is refunded, the license key is revoked. After 14 days we refund only when the law requires it.
The Software, its documentation and all related intellectual property rights belong to Phenomenal Solutions or its suppliers. You receive only the rights this agreement expressly gives you. The Software includes third-party components that are licensed under their own terms.
To the extent the law allows, the Software is provided "AS IS", without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Software will meet your needs or work without interruption or errors.
To the extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits, business or goodwill, arising from the use of or inability to use the Software, even if we were told this could happen. Our total liability to you for any claim is limited to the amount you paid us for the Software (nothing, for the Free Edition). Nothing in this agreement limits liability that the law does not allow to be limited, and nothing affects your statutory rights as a consumer.
This agreement lasts until it is ended. You can end it at any time by uninstalling the Software. We can end it, and revoke your license, if you break it. When it ends, you must stop using the Software and delete your copies. Sections 4, 11, 12, 13 and 15 continue after termination.
(a) Changes: we may update this agreement for future versions; the version shown at installation applies to that version. (b) If any part of this agreement is held unenforceable, the rest stays in effect. (c) This is the whole agreement between you and us about the Software. (d) This agreement is governed by the laws of the country in which Phenomenal Solutions is based, and the courts of that country have jurisdiction, except where the law of your country gives you the right to use your local courts as a consumer.
